Policies

The following Policies apply to your registration for any of our classes, lessons, programmes, or courses (together referred to as “Programmes”),

Acknowledgement

  • 1.1 - Upon enrolment, The English Academics assumes that the customer has read, understood and agreed to the company’s policies. “The English Academics Limited”, “we”, “our” and “us” refer to The English Academics Limited and any of its subsidiaries. “You” and “your” refer to the student and/or their parent or guardian, as applicable.
  • 1.2 - To the fullest extent allowed by law, The English Academics Limited and all of our staff, directors and shareholders are not responsible for any loss, expense, damage, delay, injury, claim, liability, costs, or compensation—whether direct, indirect, or consequential—arising from or related to your participation in our programmes, your use of our premises, or your engagement with our services, except in cases of death or personal injury caused by negligence on our part or that of our team.
  • 1.3 - If any loss or damage occurs (including those caused by negligence), our liability will be reduced in proportion to your contribution to that loss or damage.

    Where our liability cannot be excluded but can be limited, our total liability for all claims connected to your participation in our programmes, use of our facilities, or engagement with our services will not exceed the total fees paid by you for the relevant programme or service.

    You agree to indemnify and hold harmless The English Academics Limited and our directors, employees and consultants against any and all claims, liabilities, costs, damages, losses, and expenses (including direct, indirect, or consequential losses, loss of profit, loss of reputation, interest, penalties, legal fees, and other professional costs) suffered or incurred by us as a result of your breach of any applicable laws, regulations, or these Policies. We reserve the right to take over the exclusive defense and control of any matter subject to indemnification by you, and you agree to assist us in defending such claims.
  • 1.4 - We may update, revise, add to, or remove any part of these Policies at our discretion, and the most current version will always be available on our website. Any updates become effective once posted online or communicated to you, and by continuing to use our services afterwards, you agree to the revised Policies.
  • 1.5 - These Policies are governed by the laws of Hong Kong and should be interpreted accordingly. Any disputes or claims related to these Policies, including any issues of breach, termination, or invalidity, will be exclusively handled by the courts of Hong Kong.
  • 1.6 - The English Academics reserves the right to make the final decision in case of any disputes.

Payment

  • 2.1 - Classes are non-transferable and fees paid are non-refundable*. If the payment is settled after the deadline, we will offer other time slots.​ In the event that the class has reached its maximum capacity, we can arrange a refund. Refunds are processed by cheques only*. Cheques must be picked up at the centre. We do not provide postage services.
  • 2.2 - Fees for the next month must be settled on or before the last class of the month to secure your child’s place. E.g. If the child’s last class in August is on 29th August (Wednesday), September fees must be settled on or before this day.​

  • 2.4 - Full fees for the month must be settled before commencement of all classes. We reserve the right to deny the student access to class if the full fees have not been settled. The student will still not be allowed to join the class until the specified amount is settled. No make-up time will be arranged for disruptions caused by late payment.
  • 2.5 - All places are given on a confirmation-by-payment policy. We do not accept confirmation of places by any other means. If no payment is received by the due date, it will be assumed the place has been given up. We reserve the right to release the place without prior notice. We are not responsible for payment reminders.
  • 2.6 - All places, including make-up classes, are given on a first-come-first-served basis.
  • 2.7 - We will only acknowledge the payment with proof of receipt and it must be given by the due date. Any receipts sent after the due date will not be accepted irrespective of the transaction time. We will not acknowledge the payment if no receipt is given.
  • 2.8 - We reserve the right to terminate a student's classes and provide a refund at any point during the month. This action may be taken if we determine that the student's behaviour is disruptive or if any matters arise that we deem disruptive to the regular operation of the centre. The refund will be issued in a form determined by the centre.

*The English Academics reserves the right to final judgement regarding refunds.

Sick Leave

  • 3.1 - In the event a student needs to take sick leave, a doctor’s note specifying the date of the class missed must be presented in order to reschedule the class. We reserve the right to deny make-up classes if a doctor’s note is not presented.
  • 3.2 - In the event a teacher is sick, classes will be held online for the safety and wellbeing of our students, unless otherwise specified by The English Academics.
  • 3.3 - Students will be notified as soon as possible of the change to online classes and provided with instructions on how to access the virtual classroom. We will not be held responsible for any issues that arise from parents' failure to receive or act on these notifications.

Class Arrangement

  • 4.1 - All classes must be enrolled and paid for on a monthly basis. Classes cannot be skipped. Missed classes, for any reason, will not be credited towards future payments or substituted for subsequent months.
  • 4.2 - For all group classes, students are required to follow the curriculum and materials provided by us. Individual or special content requests will not be accommodated in group sessions. Only private classes may be tailored to individual requests.
  • 4.3 - We must be notified of any class changes or cancellations at least 24 hours before the scheduled class. The class will be considered as taken for no shows or if late notification is given. No make-up classes will be arranged.
  • 4.4 - We will not make up for any late arrivals to classes.
  • 4.5 - A minimum of two students is required to start a class.
  • 4.6 - With the exception of private class, students will work on materials that are provided by us. Any special requirements (e.g. homework, research assignments) will be considered as a private class and shall be charged at the private rate of HKD 1200/hour.
  • 4.7 - For private class arrangements, the customer is responsible for notifying us at least 48 hours before the scheduled time if there are any specific requirements. We reserve the right to deny any late requests.

  • 4.8 - Teachers shall be assigned to classes at the sole discretion of The English Academics, subject to course content, teacher availability, and the overall benefit of the group class. The English Academics reserves the right to assign or substitute any teacher for any class at any time, without prior notice. The English Academics does not guarantee the fulfilment of any teacher preferences for group classes. In the event a substitute teacher is provided, the class shall proceed as scheduled. If The English Academics is unable to provide a substitute teacher for a scheduled class, a refund for the affected class session shall be issued.
  • 4.9 - We reserve the right to not disclose the number of students in each class. The maximum for all group classes is 5.
  • 4.10 - For child protection purposes, cameras are installed in classrooms. All recordings will be kept confidential.

Make-up Arrangement

  • 5.1 - All paid classes must be completed within six weeks from the date of the first class; any unused classes after this period will be forfeited. All missed classes must be made up within the specified deadline, and any missed classes not made up by the due date will be charged.
  • 5.2 - Make-up classes cannot be used in lieu of payment for the following months' classes.
  • 5.3 - You are solely responsible for scheduling your own make-up classes. All make-up sessions must be arranged promptly and before the specified deadline. We are not responsible for issuing any reminders for make-up classes.
  • 5.4 -  Except in cases of sick leave with proof of a doctor's note specifying the date of the missed class, each student may be permitted to one leave request per month. Any additional rescheduling requests, regardless of reason, will incur an administrative fee of HKD 150 per change. No alternative time slots will be provided until the administrative fee has been paid in full.The administrative fee will only be waived if the student provides a doctor’s note that is issued within 48 hours from the date of the missed class.
  • 5.5 - Rescheduling a class that has already been rescheduled shall be deemed an additional leave request and will incur an administrative fee of HKD 150.
  • 5.6- Materials from the missed class will be distributed to you if you are unable to attend a make-up class.
  • 5.7 - Make-up classes are offered solely to fulfil paid class sessions. You acknowledge and agree that available make-up time slots may not align with your personal schedule.

The English Academics does not guarantee that make-up classes will:
1. be suitable;
2. match the same level, content, or topics as the missed class; or
3. meet any personal expectations

Make-up class options may include alternative courses of equivalent value, subject to availability and at the sole discretion of The English Academics.

  • 5.8- Due to limited staff and class size limitations, all class time slots offered are final. Any requested make-up class time slots other than the offered times slots would be a private class time slot, and will be charged accordingly at HKD 1200/ hour.​

Online Classes

  • 6.1 - It is the responsibility of the student or parent to familiarise themselves with our Zoom instructions prior to the start of class. We are unable to pause class sessions to assist individuals with technical difficulties. We are not liable for any issues related to internet connectivity or technology that may occur before or during class. While we will provide notes for any content missed, please note that no make-up classes will be offered.
  • 6.2 - The student is responsible for saving his/her own work and remember it has been saved. We will not have a copy of the work.​
  • 6.3 - Students must take online classes on a computer, not a tablet or a Chromebook. We do not take any responsibility for issues that arise from not following this instruction.​

Holiday & Closures

  • 7.1 - We are closed on Mondays and Public Holidays.
  • 7.2 - Typhoons: When the signal is raised 2 HOURS before the scheduled class:
  1. T.1 - Classes will run as normal for all students.
  2. T.2 -
  3. T.3 - For Primary and Secondary students, classes will run as normal at the centre and online. Classes will be switched to online for kindergarten students.
  4. T.8 & Above - The centre is closed and all classes will be switched to online.
  • 7.3 - Rainstorms
  1. Amber Rainstorm - For Primary and Secondary students, classes will run as normal at the centre and online.Classes will be switched to online for kindergarten students.
  2. Red Rainstorm - The centre is closed and all classes will be switched to online.
  3. Black Rainstorm - The centre is closed and all classes will be switched to online.
  • 7.4 - For Typhoons and Rainstorms, should T.8 or above for Typhoons or Red & Black Rainstorm warnings be hoisted during class time at the centre, classes will continue. Students will remain at the centre until parents are able to pick their children up once the typhoon or rainstorm signal has been lifted or when it is safe to do so.
  • *We are unable to reschedule any classes due to inclement weather. Students have the option of attending the class online or receiving notes instead.

Your Responsibilities

  • 8.1 -You agree not to approach or arrange private lessons with our instructors, tutors, or any staff engaged by us without our prior written approval.
  • 8.2 - You are responsible for arranging appropriate and timely transport or pick-up for the student to and from us. Students are not required to inform us when they leave the premises.
  • 8.3 - You are responsible for notifying us in advance in the required timeframe of any leave requests, arranging make-up classes before the specified deadline, making all payments on time, and attending classes as agreed.
